HTC is porn

If it was not enough for the maker of Android smartphones, HTC, to have to deal with m’learned patent troll from Apple, it seems that the outfit also has to deal with small briefs from the porn industry.

HTC lawyers must have thought they had seen everything until they got a cease and desist letter from Vivid Studios claiming that the smartphone maker was infringing on its trademark.

According to AP, Vivid  fears that punters will not be able to tell the difference between a smartphone and content which involves people taking their clothes off and having sex. We would have thought that while there is probably a lot more silicone in an Vivid flick than an HTC phone, that is where any resemblance stops.  Only an Apple fanboy would think that a smartphone is better than sex.

Vivid’s attorney Mark Hoffman admits that it is a bit far fetched to believe consumers would confuse a smartphone with a porn studio.  But Vivid content comes through a variety of digital channels, including smartphones. So punters might be on their smartphones, looking for porn and accidentally trip over an advert for an HTC phone. There is nothing worse than trying to keep abreast of things and end up walking away with a telling bone, to use rhyming slang.

Hoffman has given HTC until Monday to change the name of the product, or he will go for the money shot in court.

Vivid Entertainment has been around since 1984 and is probably the biggest and most thrusting of adult movie studios. It produced thousands of adult movies, including the infamous Paris Hilton and Kim Kardashian sex tapes which did not really require any production at all.

Still with all the nonsense about breaching Apple patents, HTC probably could do without this particular writ.
