Google pulls back on Microsoft patent claims

Google appears to be losing heart on at least two of its patent claims against Microsoft.

Google unit Motorola Mobility has asked the International Trade Commission to drop two key patents from an infringement complaint that it filed against Microsoft’s Xbox. According to Reuters, one patent remains.

The move was required under an agreement that Google made with the Federal Trade Commission last week to sort out its long-running antitrust investigations.

It is also being made against a background where the FTC, US Department of Justice and US Patent and Trademark Office have been stating that companies should not request sales bans when filing patent infringement lawsuits based on patents that are essential to a standard in most cases.

Microsoft said that it was pleased that Google had finally withdrawn these claims for sales bans against Microsoft.

Microsoft said that the patents had been asserted in cases in Wisconsin and Washington district courts.
